Once accepted as a Certified Host, it is expected that the company will display the "Certified By HostCheck" button found in his Control Panel prominently on their Web Site both to show that they are a certified member and to allow their users to participate by posting reviews on their performance.
By proceeding you agree to indemnify, defend and hold HostCheck, its affiliates, and their respective officers, directors, owners and agents harmless from any and all liability, losses, costs and expenses, including direct, special direct or consequential losses or damages howsoever arising from any use of or reliance on any of the information contained in this site.
The parties’ obligations under this Agreement are subject to, and neither party shall be liable for, delays, failures to perform, damages, losses or destruction, or malfunction of any equipment or any consequence thereof caused or occasioned by, or due to fire, flood, water, the elements, labor disputes or shortages, utility curtailments, power failures, explosions, civil disturbances, governmental actions, shortages of equipment for supplies, unavailability of transportation, acts or omissions of third parties, or any other cause beyond the party’s reasonable control.
IN NO EVENT SHALL HOSTCHECK BE LIABLE TO APPLICANT OR ANY OR APPLICANT’S CUSTOMERS OR ANY OTHER PERSON, FIRM OR ENTITY IN ANY OTHER RESPECT, FOR DIRECT, INDIRECT, CONSEQUENTIAL,SPECIAL, INCIDENTAL, ACTUAL, OR PUNITIVE DAMAGES, OR FOR ANY LOST PROFITS OF ANY KIND OR NATURE WHATSOEVER, EVEN IF FORESEEABLE, ARISING OUT OF ANY MISTAKE, ACCIDENT, ERROR, OMISSION, INTERRUPTION, OR DEFECT IN TRANSMISSION,OR DELAY ARISING OUT OF OR RELATING TO THE SERVICES OR THE OBLIGATIONS OF HOSTCHECK PURSUANT TO THIS AGREEMENT AND ANY EXHIBITS OR SCHEDULES HERETO INCLUDING, WITHOUT LIMITATION, (i) ANY FAILURE TO PROVIDE TIMELY OR ACCURATELY PROVISION ANY HOSTCHECK SERVICE, OR (ii) ADVERSE CONDITIONS WHICH MAY RESULT FROM ACTIONS BY REGULATORY OR JUDICIAL AUTHORITIES. HOSTCHECK’S ENTIRE LIABILITY FOR ANY CLAIM OR LOSS, DAMAGE OR EXPENSE FROM ANY CAUSE WHATSOEVER, EXCEPT FOR THOSE ARISING FROM OR IN CONNECTION WITH HOSTCHECK’S GROSS NEGLIGENCE, SHALL IN NO EVENT EXCEED THE MONIES ACTUALLY PAID TO HOSTCHECK UNDER THIS AGREEMENT BY APPLICANT FOR THE SPECIFIC SERVICES THAT GIVE RISE TO THE CLAIM. NO ACTION OR PROCEEDING AGAINST HOSTCHECK MAY BE COMMENCED MORE THAN ONE YEAR AFTER THE SERVICES ARE RENDERED. THIS SITE AND IT'S CONTENT ARE DISTRIBUTED ON AN "AS IS, AS AVAILABLE" BASIS. WE MAKE NO GUARANTEES AS TO RESULTS THAT CAN BE OBTAINED.
HostCheck does not necessarily endorse, support, sanction, encourage, or agree with the content, comments, opinions or statements of HostCheck members. Information, products, and services offered, sold or placed online by HostCheck members belong to the respective companies or individuals who place them there and are not representative of HostCheck.

HostCheck shall not be liable for any damages allegedly sustained arising out of use of the information, products and services. HostCheck's only liability in the event of errors shall be the correction or removal of the erroneous information after verification, and if necessary cancellation of a web hosting company's membership.
The failure of either party to enforce or insist upon compliance with any of the provisions of the Agreement or the waiver thereof, in any instance, shall not be construed as a general waiver or relinquishment of any other provision of this Agreement.
This site and its content is protected by copyright as a collective work and/or compilation, pursuant to Canadian copyright laws, international conventions, and other copyright laws. Any reproduction, modification, publication, transmission, transfer, sale, distribution, performance, display or exploitation of any of the content from this site, whether in whole or in part, without the express written permission of HostCheck is strictly prohibited.
Any disputes that may arise under this Agreement shall be resolved in accordance with the laws of the Province of Ontario. Each party agrees that jurisdiction and venue for any and all disputes under this Agreement will be proper in the Cumberland District of the Province of Ontario, Canada, and that the establishment of such jurisdiction and venue shall be determined by HostCheck.
